Man says he's tired of being mistaken for MJ

A Portland, Ore. man has filed a lawsuit for $832 million, saying he is tired of being mistaken for Michael Jordan, according to KGW-TV.

The television station's Web site says Allen Heckard filed the suit against His Airness and Nike founder Phil Knight on June 29 in county court, claiming to have been mistaken for the basketball legend nearly every day for the past 15 years.

And he's tired of it.

"I'm constantly being accused of looking like Michael and it makes it very uncomfortable for me," Heckard reportedly said.

Heckard apparently is suing Jordan for defamation and permanent injury, emotional pain and suffering. He is suing Knight for defamation and permanent injury for promoting Jordan and making him one of the world's most famous athletes.

Heckard, who stands slightly taller than 6 feet, says many people miss the fact that he is roughly six inches shorter than Jordan.

But Heckard bears a physical resemblance to Jordan because he has a shaved head, an earring in his left ear, and is in good physical shape — from playing basketball.

"Even when I go to the gym I'm being accused of playing ball like him (Jordan)," Heckard said.

Wouldn't most people consider that a compliment?

"Yes, don't get me wrong it's definitely a positive thing, because Michael, like I say is one of the best ball players that I've known to play the game. But then again, that's Michael and I'm me. So I want to be recognized as me just like Michael's being recognized as Michael."

The television station apparently caught Heckard wearing blue Air Jordan tennis shoes.

Is Heckard trying to look like Jordan?

No.

"They're very comfortable shoes to play ball in," said Heckard. "I play a lot of basketball and any other shoes I try to play in tend to hurt the bottom of my feet."

What made Heckard decide to file suit against Jordan and Knight for $416 million each?

"Well, you figure with my age and you multiply that times seven and then I turn around and I figure that's what it all boils down to."

Haha tricky little plaintiff in this case. In Oregon they still require in order for you to get sanctions for a frivilous lawsuit that you prove bad faith or wantonly (grossly negligent ie reckless).

http://www.aepronet.org/pn/vol6-no2.html

Here is the definition of defamation, it makes absolutely no sense with what the guy is claiming. All it should take is a motion to dismiss.

QUOTE
defamation
n. the act of making untrue statements about another which damages his/her reputation. If the defamatory statement is printed or broadcast over the media it is libel and, if only oral, it is slander. Public figures, including officeholders and candidates, have to show that the defamation was made with malicious intent and was not just fair comment. Damages for slander may be limited to actual (special) damages unless there is malice. Some statements such as an accusation of having committed a crime, having a feared disease or being unable to perform one's occupation are called libel per se or slander per se and can more easily lead to large money awards in court and even punitive damage recovery by the person harmed. Most states provide for a demand for a printed retraction of defamation and only allow a lawsuit if there is no such admission of error.

Good for a laugh.

the sad thing is, he will probably get a couple million to. Juries are full of dumbasses.

Posted by: HITStheDAGGER Jul 7 2006, 11:35 PM

I just can't get over this... 832 Mil

The only other lawsuit that envolved so much money that i could find was this.

New York Jets v. Cablevision (2005) - The NY Jets sued Cablevision, the owner of Madison Square Gardens for unlawful and anticompetitive behavior. The Jets alleged that Cablevision wrongfully tried to prevent the Jets from building a football stadium, and that Cablevision refused to carry commercials supporting the stadium.
And it was for 600 Mil

I'm sick and tired of my game being confused with Jordan's. mad.gif

Posted by: dasox24 Jul 8 2006, 12:23 AM

Man, I'm sick of all these sue-happy people these days. Quit being little bitches and deal with whatever stupid little thing you want to sue over.

I wish I had lived back in the 50s. The world sucks now and it seems like it'll only get worse. dry.gif

Posted by: Giant Killer Jul 8 2006, 12:33 AM

haha, my game is often compared to Pargo's. I've yet to figure out if thats a good thing. huh.gif

Posted by: HoofHearted Jul 8 2006, 12:43 AM

What a flippin' j'moke. Seriously, this guy should get tossed in the slammer just for saying he has been told he looks like MJ, along with those who have told him he looks like MJ. He should be forced to have a "vexatious litigant" shirt on at all times.

No, it's not.

It means you're a streaky shooter who turns the ball over a lot and makes tons of bad decisions on the court, but, wehn you're on a streak, you can carry your team. But most of the time you just dribble a lot, shoot a 3, and miss. wink.gif

BTW, this coming from the guy whose game is compared to Peja.

I'm more of a Duhon, don't really shoot, pass A LOT, and play tough D (no blood no foul man) wink.gif

They only compare me to Peja because I'm a tall Serbian. laugh.gif But, I'd say I play more like Steve Nash. Shoot a lot and make flashy passes, except I'm taller than Nash.

Yeah, that is definitely me too. I used to be able to shoot really well when I was in middle school and practiced every day. Now, I can't shoot well at all, but that's really b/c when I stopped playing in high school, I didn't pick up a basketball for like 3 years until I started playing some pickup games this year.

It's kinda sad, but I think myself as an 8th grader would probably beat myself now. tongue.gif
