So far, according to ESPN, he has not been charged with a criminal complaint. He has been only charged by the SEC, and they don't have the ability to send him to jail, only to fine him regarding the money he made. It is possible a criminal complaint could be filed against him in the future.

Being in the industry, it looks like a pretty cut and dry case so far. I'd be interested to hear what Cuban's side of it really is.
